Nevin Shapiro
TAP TO READ FULL NARRATIVE — THE ACCESS (600 WORDS)
PART ONE: THE SCHEME
Shapiro ran Capitol Investments USA, a company that claimed to operate in the grocery distribution business. It took in approximately $930 million from investors between January 2005 and November 2009 through a Ponzi structure: new investor money was used to pay returns to earlier investors, rather than generated by actual business activity. Capitol Investments had, in the DOJ's words, virtually no income-generating business. Shapiro took more than $35 million for himself, including more than $5 million in gambling and about $400,000 in Miami Heat tickets.
The hook was Shapiro's social presence in Miami — his connections to University of Miami athletes, his access to events and celebrities, his lifestyle. Investors bought in partly because they believed the man, and they believed the man partly because they could see he ran in real circles. [SOURCE: DOJ indictment; SEC civil complaint]
PART TWO: THE UNIVERSITY INVESTIGATION
Separate from the criminal case, the NCAA and the University of Miami conducted investigations into whether Shapiro provided impermissible benefits to University of Miami athletes — gifts, entertainment, and other items that violated NCAA eligibility rules. Those investigations were complex and drawn out. The University imposed sanctions on itself as part of a resolution.
The University of Miami was not criminally charged. The investigations and sanctions described above are administrative and regulatory proceedings under NCAA rules, not criminal findings. [SOURCE: NCAA investigation record; University of Miami statement]
PART THREE: CONVICTION
Shapiro was charged in Newark on 21 April 2010, the same day the SEC sued him, and pleaded guilty on 15 September 2010 to securities fraud and money laundering. On 7 June 2011 Judge Susan Wigenton of the District of New Jersey sentenced him to 20 years in federal prison and ordered $82.66 million in restitution; the DOJ put investors' losses at $50 million to $100 million. VERIFIED: He was moved to home confinement on 11 June 2020 under the CARES Act, and on 12 December 2024 President Biden commuted his sentence along with some 1,500 others in home confinement; he was released on 22 December 2024. [SOURCE: ESPN/AP, 14 December 2024]
