WHERE IT STARTED
FIRST SEEN: c. 2008-2010 (US payday-loan phantom debt) · GOING FOR: About 17 years

Phantom debt collection was first documented by the FTC in the United States around 2010, tied to leaked payday-loan applications, with the first major action against Kirit Patel's India-linked operation in 2012.

'Phantom debt' collection - demanding payment of debts that do not exist or are not owed to the caller - grew out of the US payday-loan boom of the 2000s, when application data leaked to call centres in the US and India. Callers posed as police, investigators or law firms and threatened arrest. The FTC's first big case was against Kirit Patel's Broadway Global Master in 2012 (an India-based operation), and John Williams of Williams, Scott & Associates became one of the first collectors criminally convicted in 2016. The scam continues with new shells such as Global Circulation Inc (2024) and Blackstone Legal (2025), now also covered by the FTC's 2024 Impersonation Rule.

HOW IT WORKS

The operator buys or steals lead data from payday-loan applications or old debt portfolios, then calls victims claiming to be a law firm, 'investigator' or government agent collecting a loan the victim applied for or repaid years ago. Callers cite real personal details, threaten arrest, lawsuits, wage garnishment or contacting employers and relatives, and offer a 'settlement' if paid today by card or bank transfer. Because the details are accurate and the threats frightening, many victims pay small sums repeatedly. Some operations collect on real but time-barred or already-paid debts, or inflate balances.

HOW USEFUL IT IS TO CRIMINALS

A lead list and a call centre are the only requirements; accurate personal details plus threats of arrest produce payments of a few hundred dollars from a large share of victims, and Global Circulation Inc collected $7.6 million in about two years. The FTC's remedies are usually bans and suspended judgments; only a few operators (Patel, Williams) have gone to prison.

THE DAMAGE IT HAS CAUSED
$7.6 million
Bogus debt collected by Global Circulation Inc, the largest recent FTC case (no national total published) — FTC, Nov 2024

No body publishes a phantom-debt total; the largest measured cases are GCI's $7.6 million (FTC, 2024) and Patel's $5 million-plus (FTC, 2015). Non-money harm: victims are threatened with arrest, employers and relatives are harassed, and some pay debts they never owed out of fear.

6,000 Consumers defrauded of about $4 million by Williams, Scott & Associates (US Attorney's Office SDNY, 2016)
